1. Explain special provisions in the Constitution of India for the Northeast region.

The Constitution of India includes several special provisions that address the unique cultural, social, and economic characteristics of the Northeast region, recognizing the diversity and distinctive identities of the region’s numerous tribes and ethnic groups.

Article 371(A) – Nagaland: This article provides that no Act of Parliament will apply to Nagaland in matters of religious or social practices of the Nagas, its customary law and procedure, administration of civil and criminal justice involving decisions according to Naga customary law, and ownership and transfer of land and its resources. It requires the Nagaland Legislative Assembly’s approval for applying any Act of Parliament relating to these matters.

Article 371(B) – Assam: It allows for the creation of the state legislative assembly constituencies to provide for the representation of the tribal areas of Assam.

Article 371(C) – Manipur: This article mandates the President to form a committee of elected members of the state assembly consisting of members mainly from the Hill areas in Manipur. Any Act of Parliament or the state legislature on matters of the Hill areas will have to be referred to this committee.

Article 371(F) – Sikkim: This article provides for the protection of existing laws and rights in Sikkim, with the provision that the President can cease or modify these in consultation with the Governor. It also protects the tenure of the sitting members of the legislative assembly at the time of Sikkim’s incorporation into India.

Article 371(G) – Mizoram: This article contains provisions similar to that of 371(A) for Nagaland. It mandates that the Mizoram Legislative Assembly’s approval is necessary for applying any Act of Parliament related to religious or social practices, customary law and procedure, administration of civil and criminal justice, and ownership and transfer of land.

Article 371(H) – Arunachal Pradesh: This article empowers the Governor with a special responsibility to maintain security in the state, given its strategic location. The President can further specify these responsibilities.

Sixth Schedule – Assam, Meghalaya, Tripura, and Mizoram: The Sixth Schedule of the Constitution contains provisions for the administration of tribal areas in these states. It allows for the formation of Autonomous District Councils, which can legislate on matters such as land, forests, inheritance, marriage, and social customs. These councils also have the power to establish courts for trials of suits and cases where parties belong to Scheduled Tribes.

These special provisions aim to safeguard the cultural, social, and economic rights of the tribal and ethnic communities in the Northeast, as well as to address the region’s security concerns. They highlight the Constitution’s flexibility and its commitment to the principles of diversity and decentralization.

1. Trace the life cycle of a conflict.

A conflict, whether it’s at an interpersonal, societal, or international level, generally passes through several stages in what is termed as its “life cycle”. It is important to understand that this cycle is not a rigid or linear process but can fluctuate based on multiple variables.

Latent Conflict: In this initial stage, the sources of conflict exist, but those involved may not be fully aware of them. These could include economic disparity, social inequality, or political repression. The tensions are underlying, and no outright conflict has yet occurred. The situation appears calm on the surface, but potential triggers are present.

Emergence: During this phase, the parties become aware of the conflict. The issues or differences that were latent now become overt. Disputes may begin to surface, and the parties might start articulating their interests, needs, or demands, which can lead to agitation and escalation of tensions. Communication between parties may become strained or break down completely.

Escalation: This is a critical stage of conflict where disagreements become more intense. The parties become more entrenched in their positions, leading to a rise in hostility. The conflict can escalate in various ways – in the number of parties involved, the issues that are included, or the tactics used. It can manifest as a full-blown war in international conflicts, strike actions in labor disputes, or deep-seated resentment in interpersonal conflicts. At this stage, the cost of conflict becomes increasingly apparent, both in terms of human suffering and resource expenditure.

Stalemate or Crisis: After escalation, the conflict reaches a stalemate or crisis point. Both parties might be exhausted by the conflict and may begin to realize that they cannot win by merely continuing their current strategy. This stage often opens the door for negotiation or intervention as the parties may start looking for a way out of the conflict.

De-escalation/Negotiation: During this phase, the parties start moving towards resolving the conflict. They begin to explore options, often with the help of mediators or third-party negotiators. The focus shifts from adversarial positions to shared interests. This is often accompanied by confidence-building measures to establish trust.

Settlement/Resolution: In this stage, the parties reach an agreement that adequately addresses their interests or needs. This could be a peace treaty in the case of international conflicts, an agreement or contract in labor disputes, or a personal apology in interpersonal conflicts. It marks the formal end of the conflict, but the resolution must be implemented and monitored to ensure it is sustainable.

Post-Conflict Peacebuilding/Reconciliation: This final stage involves rebuilding and healing the relationship between the conflicting parties. It may require addressing the root causes of the conflict, implementing social or economic reforms, and promoting reconciliation and healing. The aim is to prevent the recurrence of conflict and build a lasting peace.

It’s important to note that a conflict can cycle back to earlier stages, especially if the root causes aren’t adequately addressed or if the settlement isn’t properly implemented or upheld. Hence, conflict resolution requires comprehensive and sustained efforts at every stage of the conflict life cycle.

1. Compare India’s foreign policy under UPA and NDA –II regimes.

India’s foreign policy has seen distinct characteristics under the United Progressive Alliance (UPA) and the National Democratic Alliance-II (NDA-II) governments. It is crucial to note that foreign policy is a continuum, and change is often evolutionary, not revolutionary.

Under the UPA regime (2004-2014), headed by Prime Minister Manmohan Singh, India’s foreign policy was geared towards fostering a multi-polar world order and integrating India into global economic systems. The ‘Look East Policy’ was transformed into the ‘Act East Policy’, signalling a more proactive approach towards Asia, particularly Southeast Asia. This period saw a significant consolidation of relations with the Association of Southeast Asian Nations (ASEAN).

The UPA government also sought to reset relations with the United States, culminating in the landmark India-US Civil Nuclear Agreement of 2008. This agreement not only symbolized a shift in Indo-US relations but also had a transformative impact on India’s standing in the international nuclear order.

The UPA government pursued a policy of dialogue with Pakistan despite several hiccups, with the Sharm el-Sheikh joint statement of 2009 being particularly controversial. Relations with China were marked by a mixture of competition and cooperation, as exemplified by the boundary defence agreement signed in 2013.

Under the NDA-II regime (2014-present), led by Prime Minister Narendra Modi, India’s foreign policy has seen a marked shift in emphasis. There has been a renewed focus on India’s immediate neighborhood with the ‘Neighborhood First’ policy, symbolizing a more proactive and engaging stance towards South Asia.

The Modi government has demonstrated a more assertive stance on China, as seen in the Doklam standoff in 2017. There has been a strategic push to counter China’s influence through initiatives such as the Quadrilateral Security Dialogue (‘Quad’) involving the US, Australia, Japan, and India.

Under NDA-II, Indo-US ties have further deepened, with increased defence and security cooperation, including the signing of foundational defence agreements such as COMCASA and BECA. However, occasional disagreements, particularly on trade and climate change issues, have punctuated the relationship.

1. Write a note on Gandhi’s struggles in South Africa.

Before becoming the spearhead of India’s struggle for independence, Mahatma Gandhi spent two pivotal decades (1893-1914) in South Africa, shaping his philosophy of nonviolent resistance, known as “Satyagraha”. Gandhi’s struggles in South Africa were instrumental in his evolution as a political and social activist.

After graduating from law school, Gandhi accepted a job in South Africa to work on a legal case. The racial discrimination he experienced, combined with the harsh treatment of Indian immigrants, deeply disturbed him. This injustice propelled Gandhi into a life of social and political activism.

In 1894, Gandhi founded the Natal Indian Congress, an organization aiming to fight discrimination against Indians in South Africa. It began the process of forging unity among the Indian community and raised awareness about their plight to authorities in both South Africa and India. The Natal Indian Congress marked Gandhi’s first attempt at organized political activism, and it laid the foundation for his future endeavors.

One of the most significant moments in Gandhi’s South African struggle was his confrontation with the discriminatory pass laws. In 1906, the Transvaal government proposed new regulations requiring Asians to carry ‘passes’, akin to internal passports. These laws were designed to restrict the movements of non-whites and further entrench segregationist policies. Gandhi organized a mass meeting in Johannesburg, where attendees unanimously agreed to resist these laws, even at the risk of imprisonment or deportation. This was the inception of Satyagraha, Gandhi’s philosophy of nonviolent civil disobedience.

Satyagraha, literally meaning ‘truth force’, was a strategy of resistance against unjust laws. Through nonviolent protest and passive resistance, Gandhi aimed to expose the inherent injustices of the laws, thus prompting moral and legislative changes. He, along with thousands of Indians, defied the pass laws and accepted the consequences willingly, enduring imprisonment, floggings, and financial ruin.

In 1913, the South African government further tightened the restrictions, which led to the most impactful Satyagraha campaign. This included a march across the Natal-Transvaal border, a ‘no-tax campaign’, and a three-day strike by Indian miners. Despite brutal suppressions, the movement gathered significant momentum, eventually compelling the South African authorities to negotiate.

These negotiations led to the passage of the Indian Relief Act in 1914, which invalidated the £3 tax imposed on ex-indentured Indians, recognized the validity of Indian marriages, and eased restrictions on Indian immigration. Though the Act did not completely eradicate the discrimination faced by Indians in South Africa, it marked a significant victory for Gandhi and the Indian community.

Gandhi’s South African struggle was a transformative phase in his life. It molded him into a potent political force and provided him with the philosophical tools he would later use to lead India to independence. His experiences in South Africa strengthened his belief in the power of nonviolent resistance, cemented his commitment to social justice, and reaffirmed his dedication to achieving political freedom through peaceful means. His concept of Satyagraha, born amidst the struggles of South Africa, became a beacon of hope and resilience for oppressed communities worldwide, standing as a testament to Gandhi’s legacy.
