IGNOU MIP 102 Question Paper

Q1. What is a patent? What are the essential requirements to obtain a patent in India.

A patent is a legal document granted by a government authority that gives an inventor the exclusive right to make, use, and sell an invention for a limited period, typically 20 years from the filing date of the application. This exclusive right allows the inventor to prevent others from making, using, selling, or distributing the patented invention without permission.

Inventive Step (Non-obviousness): The invention should involve an inventive step that is not obvious to a person skilled in the relevant field of technology. In other words, it must not be something that would be obvious for an expert in the field to come up with based on existing knowledge.

Industrial Applicability: The invention must be capable of being made or used in some kind of industry. It should have practical utility and should not be purely theoretical.

Non-Patentable Subject Matter: Certain subject matters are not eligible for patent protection in India, such as inventions that are contrary to law, inventions that are frivolous, inventions that would be harmful to humans, animals, plants, or the environment, and methods of agriculture or horticulture.

Sufficient Disclosure (Enablement): The patent application must provide sufficient disclosure of the invention so that someone skilled in the relevant field would be able to implement or reproduce the invention based on the information provided in the application.

Clarity and Completeness: The patent application must be clear and complete, describing the invention in a manner that enables a person skilled in the relevant field to understand and replicate the invention without undue experimentation.

Meeting these requirements is crucial for a successful patent application in India. Additionally, the patent application process involves filing the application with the Indian Patent Office, paying the necessary fees, and undergoing examination to ensure that the invention meets the patentability criteria.
